Business Listing Agreement
i) This Business Listing Agreement (the “Agreement”) is between the app company (hereinafter referred to as the “The Travel”) with the business company (hereinafter referred to as the “ownership”).
ii) The purpose of this Agreement is to outline the terms and conditions under which the Business will be listed on The Travel mobile application.
iii) The date of the Agreement shall start automatically once the Ownership listing live on app both android and IOS version with mutual agreement to the following terms and conditions:
1) Scope of Services
A) The Travel agrees to:
a. List the Business on the App in the relevant category(ies).
b. Provide visibility to the Business as per the App’s standard policies.
c. Maintain the listing as long as this Agreement remains in effect.
B) The Ownership agrees to:
a. Provide accurate and up-to-date information about its products/services.
b. Notify The Travel promptly of any changes to the information provided.
c. Adhere to the App’s content and listing guidelines as well as business listing model.
d. Agree with the ownership responsibility.
2) Listing Fee
The listing is subject to a fee under The Travel package listing and pricing is subject to change upon certain periods.
- Payment Terms: Ownership pay according package listing subcription. The price and services as stated in the package listing.
- Refund Policy: Full refund with RM 5 will be deducted for processing fees, and will be made within 30 days after processed termination approved.
3) Representations and Warranties
a. The Ownership warrants that all information provided for the listing is accurate and does not infringe any third-party rights.
b. The Travel does not guarantee specific results, visibility, or sales through the listing.
4) Indemnification
The Ownership agrees to indemnify and hold harmless the App Owner from any claims, damages, or liabilities arising from the content provided by the Business or the Business’s activities.
5) Limitation of Liability
The Travel shall not be liable for any indirect, incidental, or consequential damages related to the listing of the Business.
6) Intellectual Property
The Ownership grants The Travel a non-exclusive, royalty-free license to use its trademarks, logos, and other intellectual property solely for the purposes of listing and promoting the Business on the App.
7) Confidentiality
Both parties agree to keep confidential any non-public information shared under this Agreement.
8) Term and Termination
a. Term: This Agreement shall remain in effect for a period of 10 years, starting from the date of execution, unless terminated earlier as provided herein.
b. Termination by Ownership: Ownership may terminate this Agreement by providing 30 days’ written notice to the other party. Listing of the business ownership will be terminated within 14 days upon processed termination approved.
c. Termination for Cause: The Travel may terminate this Agreement immediately if the Ownership violates the terms of this Agreement or the business model has changed or violates the App’s guidelines.
9) Governing Law
This Agreement shall be governed by the laws of [Jurisdiction].
